When the property is completed by a builder, it is typically inspected by the NHBC for structural soundness as part of their ‘Benchmark’ policy this will enable ongoing NHBC warranty for 10 years of the life of the property. The first 2 years of this is covered by the builders defect warranty period.
The NHBC report does not cover cosmetic, functional, working and environmental defects which may affect the quality of living in the property.
New houses fall outside is the guidelines for the requirement of the Housing Act 2004 for requiring a Home Condition Reports, as it is deemed the property having just been completed, would not have any defects. This blue-sky theory is very often disproven by the production of a Snagging Report which would detail defects within a new build property, these can be numerous and range through non working architectural hard wear, badly fitting and non working appliances, leaking and misplaced drains, draughty and ill fitting windows, door, floor timber finish details, quality of finish and predicted future failures within the property.
This type of report is an invaluable aid to New House Purchasers and enables them to resolve defect issues prior to completion, the builder will generally be keen to return and remedy the defects to enable the sale to continue. Once the sale contract as completed and the money has changed hands, it is often difficult to get a builder or nominated contractor to return to complete post sale completion defects.
New purchasers are reluctant to involve themselves in disputes with builders due to their lack of knowledge and understanding of warranty procedures and building construction.
